These Terms and Conditions ("Terms") govern your access to and use of the
PayTracc mobile application, website, and related services (collectively, the
"Service") operated by PayTracc ("we", "us", or "our"). By creating an
account or using the Service, you agree to these Terms. If you do not agree,
do not use the Service.
1. Eligibility
You must be at least 16 years old and capable of forming a binding contract
to use PayTracc. If you use the Service on behalf of an organisation, you
represent that you have authority to bind that organisation to these Terms.
2. The Service
PayTracc provides timesheet, payslip, leave, and related tools so employees
can check their pay from their employers. The Service is for informational
and organisational purposes; it is not a substitute for professional tax,
legal, or accounting advice.
Pay calculations, tax estimates, and award interpretations are provided
as aids only. You are responsible for verifying amounts with your employer,
accountant, or the Australian Taxation Office (ATO) before relying on them
for compliance or payment decisions.
3. Your account
- You must provide accurate registration information and keep it up to date.
- You are responsible for safeguarding your password and device access.
- Notify us immediately of unauthorised access at support@paytracc.com.
- One person per account unless we expressly authorise shared access.
4. Acceptable use
You agree not to:
- Use the Service for unlawful, fraudulent, or harmful purposes
- Attempt to gain unauthorised access to systems, accounts, or data
- Reverse engineer, scrape, or overload the Service except as permitted by law
- Upload malware or interfere with other users' use of the Service
- Misrepresent your identity or employment relationship
5. Your content
You retain ownership of timesheet, payslip, and other data you enter
("Your Content"). You grant us a limited licence to host, process, and
display Your Content solely to provide and improve the Service, as described
in our Privacy Policy.
You are responsible for the accuracy of Your Content and for only uploading
information you are entitled to store in connection with your own employment
and pay records.
6. Intellectual property
PayTracc, our logo, software, design, and documentation are owned by us or
our licensors. These Terms do not grant you any right to our trademarks or
brand assets except as needed to use the Service.
7. Subscriptions and fees
Some features may require payment. Pricing and billing terms are presented
before you subscribe. Fees are non-refundable except where required by the
Australian Consumer Law or expressly stated otherwise.
8. Availability and changes
We strive for reliable uptime but do not guarantee uninterrupted access. We
may modify, suspend, or discontinue features with reasonable notice where
practicable. We may update these Terms; continued use after changes constitutes
acceptance. Material changes will be communicated in-app or by email.
9. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and
"as available" without warranties of any kind, whether express or implied,
including merchantability, fitness for a particular purpose, and
non-infringement. We do not warrant that calculations are error-free or
suitable for confirming pay amounts without checking with your employer.
10. Limitation of liability
To the maximum extent permitted by law, PayTracc and its directors,
employees, and affiliates are not liable for indirect, incidental, special,
consequential, or punitive damages, or for loss of profits, data, or goodwill,
arising from your use of the Service.
Our total liability for any claim relating to the Service is limited to the
greater of (a) amounts you paid us in the twelve months before the claim, or
(b) AUD $100, except where liability cannot be limited under the Australian
Consumer Law.
11. Indemnity
You agree to indemnify PayTracc against claims arising from your breach of
these Terms, misuse of the Service, or violation of third-party rights,
except to the extent caused by our negligence or misconduct.
12. Termination
You may stop using the Service and delete your account at any time. We may
suspend or terminate access if you breach these Terms or if required by law.
Provisions that by nature should survive termination (including liability
limits, indemnity, and governing law) will survive.
13. Governing law
These Terms are governed by the laws of Australia. You submit to the
non-exclusive jurisdiction of the courts of Australia. Nothing in these Terms
limits rights you may have under the Australian Consumer Law.
